1. Introduction

Welcome to BeardStix LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile applications, including BeardStix, HerePix, BeardRanks, CheeseStix, Dumb Subs, HereStub, and Dumb Weather, and any related services (collectively, the "Service").

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Account Registration

To use certain features of the Service, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content

The Service allows you to create, upload, store, and share content, including but not limited to text, photos, and ratings ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, modify, adapt, publish, distribute, and display such User Content in connection with providing and promoting the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content;
• Your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights;
• Your User Content complies with these Terms and all applicable laws.

While you retain ownership of your original User Content, any derivative works, compilations, statistics, or other content created by BeardStix LLC based on your User Content becomes the sole property of BeardStix LLC. This includes but is not limited to aggregated data, recommendations, trending information, and anonymized statistics generated from user submissions.

We may, but have no obligation to, monitor, edit, or remove User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

4. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws;
• Infringe the rights of others, including intellectual property rights;
• Attempt to gain unauthorized access to the Service or other users' accounts;
• Interfere with or disrupt the Service or servers connected to the Service;
• Transmit any viruses, malware, or other harmful code;
• Impersonate any person or entity or misrepresent your affiliation with a person or entity;
• Use the Service for any commercial purpose without our consent;
• Scrape, data mine, or otherwise extract data from the Service in an automated manner.

5. Intellectual Property Rights

The Service and its contents, features, and functionality, including but not limited to text, graphics, logos, icons, and software, are owned by the Company and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or use any content from the Service without our prior written consent.

6. Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the content or practices of these third parties, and your use of such third-party services is subject to their respective terms and privacy policies.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, OR EXEMPLARY DAMAGES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Changes to the Terms

We may revise these Terms from time to time at our sole discretion. The most current version will be posted on the Service with the effective date. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the changes.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Pennsylvania.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
